ASSUMPTION OF RISK AND RELEASE OF LIABILITY
IN CONSIDERATION of being permitted to participate in equine activities offered by Tribal Cowboy LLC ("Tribal Cowboy"), including but not limited to horse photography prop sessions, Clydesdale wagon rides, pony parties, school programs, and related events, I, the undersigned, acknowledge, agree, and represent as follows:
INHERENT RISKS OF EQUINE ACTIVITIES. I understand and acknowledge that equine activities involve inherent risks of injury or death. Under the Idaho Equine Activities Liability Act (Idaho Code § 6-1401 et seq.), an equine activity sponsor or equine professional is not liable for an injury to or death of a participant resulting from the inherent risks of equine activities. These inherent risks include, but are not limited to: the propensity of equines to behave in ways that may result in injury; the unpredictability of equine reactions to sounds, sudden movement, or unfamiliar objects or persons; hazardous surface or subsurface conditions; equipment malfunction; and the potential for a participant to act in a negligent manner.
ASSUMPTION OF RISK. I voluntarily assume full responsibility for any risks of injury, death, or loss arising from my participation in equine activities with Tribal Cowboy, including risks resulting from the negligence of Tribal Cowboy LLC, its owners, employees, agents, or volunteers.
RELEASE OF LIABILITY. I, for myself and on behalf of my heirs, assigns, personal representatives, and next of kin, hereby RELEASE, INDEMNIFY, AND HOLD HARMLESS Tribal Cowboy LLC, its owners, officers, employees, volunteers, agents, and representatives (collectively "Released Parties") from any and all claims, demands, losses, damages, or causes of action of any kind arising out of or related to my participation in any equine activity, including any injury caused by the negligence of the Released Parties.
MEDICAL AUTHORIZATION. In the event of an emergency, I authorize Tribal Cowboy staff to seek medical treatment on my behalf or on behalf of any minor participant named herein.
RULES AND CONDUCT. I agree to follow all safety rules and instructions provided by Tribal Cowboy staff. I understand that failure to follow instructions may result in removal from the event without refund.
I confirm I have read and fully understand this document and am executing it voluntarily. My digital submission constitutes a legally binding signature to the fullest extent permitted by Idaho law.
